Terms of Service

01Agreement

These Terms of Service ("Terms") are an agreement between you and Atlas Pro Consulting LLC, a Florida limited liability company based in Tampa, Florida ("Atlas Pro", "we", "us"). They apply when you use the atlasproconsulting.com website, hire us for agency services, or use Atlas Command, our software.

By using our website, services, or software, you agree to these Terms. If you are using them on behalf of a business, you confirm you have authority to bind that business.

02Our services

We provide two kinds of services:

  • Agency services. Marketing and consulting work such as websites, CRM setup, automation, creative, and related digital services, typically under a separate proposal or statement of work. Where a signed agreement exists for a project, that agreement controls if it conflicts with these Terms.
  • Atlas Command. AI-powered business software, distributed as apps on third-party platforms (including the Wix App Market, WordPress.org, the HubSpot App Marketplace, and the Shopify App Store) and directly to clients.

03Accounts

You may need an account to use some features. Keep your login credentials secure and accurate, and let us know right away if you suspect unauthorized access. You are responsible for activity that happens under your account.

04Acceptable use

Use our services lawfully and reasonably. You agree not to:

  • Break the law, or use the services to send spam or unlawful communications;
  • Interfere with, overload, or attempt to gain unauthorized access to our systems or other customers' data;
  • Reverse engineer, copy, or resell the software except as allowed by law or by us in writing;
  • Use the services to infringe anyone's intellectual property or privacy rights; or
  • Violate the terms of the platform (Wix, WordPress, HubSpot, Shopify) through which you use Atlas Command.

We may suspend or terminate access for violations.

05Subscriptions and billing

  • Where you pay. If you install Atlas Command through a platform marketplace that requires its own billing (for example, Wix or Shopify), you are billed through that platform under its billing terms. Otherwise, we bill through Stripe.
  • Renewals. Subscriptions renew automatically until you cancel. Cancel any time through the platform you subscribed on, or by contacting us; access continues through the end of the paid period.
  • Refunds. Refunds are at our discretion unless the marketplace's own refund policy or applicable law says otherwise.
  • Price changes. We may change prices with reasonable advance notice. Changes take effect at your next renewal.
  • Agency work is billed as set out in your proposal or invoice.

06Your API keys

Some Atlas Command features let you supply your own API key for a third-party AI provider. If you do:

  • You are responsible for that key, for complying with the provider's terms, and for any charges the provider bills you for usage;
  • Content processed through those features is sent to your chosen provider under that provider's terms; and
  • We store your keys encrypted and use them only to provide the service to you.

07AI outputs

AI-generated content can contain errors, omissions, or statements that sound confident but are wrong. You are responsible for reviewing AI outputs before relying on them or sending them to your customers. Atlas Command includes approval steps for a reason: use them.

We do not guarantee that AI outputs will be accurate, complete, or fit for any particular purpose. You retain responsibility for the content you publish or send using the software.

08Intellectual property

We own the software, our website, and our branding. You own your data and your content, including content you create with the help of Atlas Command, to the extent permitted by law. You give us a limited license to process your data and content solely to provide the services. For agency work, ownership of deliverables is set out in your project agreement; unless it says otherwise, final deliverables are yours once paid for, and we keep our pre-existing tools and know-how.

09Warranty disclaimer

The services and software are provided "AS IS" and "AS AVAILABLE." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise the services will be uninterrupted, error-free, or that every defect will be corrected.

10Limitation of liability

To the fullest extent permitted by law: we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim relating to the services is limited to the amount you paid us in the 12 months before the claim arose (or 100 US dollars if you paid nothing). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

11Termination

You can stop using the services at any time, including by uninstalling an app or cancelling a subscription. We may suspend or terminate access if you violate these Terms, if required by law, or if we discontinue a service (with reasonable notice where practical). On termination, sections that by their nature should survive (such as intellectual property, disclaimers, and limitation of liability) survive. Data deletion after uninstall is described in our Privacy Policy.

12Governing law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Hillsborough County, Florida, and you consent to their jurisdiction.

13SMS Terms

Program: Atlas Pro Consulting customer care and appointment messages.

What you will receive: replies to calls and texts you send to (813) 499-9836, including a text-back when we miss your call, answers to your questions, and confirmations and reminders for appointments you book with us. We do not send messages to people who have not contacted us or opted in.

How you opt in: by calling or texting our business line, or by checking the optional SMS consent box when you book a strategy call or submit a form on our website. Consent is not a condition of any purchase or booking.

Message frequency varies based on your conversation with us. Message and data rates may apply.

To opt out, reply STOP to any message. You will receive one final message confirming you have been unsubscribed, and no further messages will be sent. Reply START to resubscribe.

Carriers are not liable for delayed or undelivered messages. See our Privacy Policy for how we handle your mobile information. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

14Changes to these Terms

We may update these Terms from time to time. If we make a material change, we will update the effective date above and, where appropriate, notify you by email or in the app. Continued use after a change means you accept the updated Terms.
